Terms of Service

By using MEPCheck AI, you agree to these terms. The most important points: MEPCheck AI is a QA/QC assistance tool and does not provide licensed engineering services. It does not replace the judgment of a licensed engineer. You retain ownership of everything you upload.
1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the MEPCheck AI website and services (collectively, the "Service"). By creating an account, making a purchase, or using the Service in any way, you agree to be bound by these Terms.
If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
2. Description of service
MEPCheck AI provides an AI-assisted quality control review tool for mechanical, electrical, and plumbing (MEP) construction documents. The Service analyzes uploaded drawings, schedules, and specifications and produces reports identifying potential design issues, code conflicts, and coordination problems.
Important limitation: MEPCheck AI is a software tool, not a licensed engineering service. Reports produced by the Service are not engineering opinions, do not constitute professional engineering services, and do not carry any professional stamp or seal. All findings must be reviewed, verified, and acted upon by a licensed engineer. MEPCheck AI accepts no liability for design decisions made on the basis of its reports.
3. Accounts and access
Registration
To access paid features, you must provide a valid name and email address and complete payment through our payment processor, Stripe. You are responsible for maintaining the confidentiality of your account credentials.
Plan limits
Each plan includes defined limits on the number of reviews per month and the maximum document size per review. These limits are enforced technically. Attempting to circumvent them — including through automated requests, shared credentials, or other means — is a violation of these Terms and may result in immediate account termination.
Team plans
Team plan seats are for use by named individuals within a single organization. Sharing access tokens with people outside your organization or with competing firms is not permitted.
4. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Upload documents that you do not have the right to share or that contain information you are prohibited from disclosing.
- Use the Service to review documents for projects where you have a conflict of interest that you have not disclosed to your client.
- Reverse engineer, decompile, or attempt to extract the underlying AI model or prompts used by the Service.
- Resell, sublicense, or make the Service available to third parties without our written consent.
- Use automated scripts or bots to make review requests beyond your plan's stated limits.
- Use the Service in any manner that could damage, disable, or impair the Service or interfere with other users.
5. Ownership and intellectual property
Your content
You retain full ownership of all documents, drawings, and files you upload to the Service. You grant us a limited, temporary license to process your uploaded content solely for the purpose of generating your review report. This license terminates when your report is delivered and your files are discarded.
Reports
Review reports generated by the Service are yours to use, share, and incorporate into your work product. You may not represent AI-generated reports as the output of a licensed engineer or include them in permit submissions as a substitute for a professional engineering review.
Our intellectual property
The MEPCheck AI name, logo, website design, software, and underlying AI systems are owned by us and protected by intellectual property law. Nothing in these Terms transfers any ownership of our intellectual property to you.
6. Payment and billing
Pricing
Current pricing is displayed on our pricing page. We reserve the right to change pricing with 30 days' notice to active subscribers. Price changes will not apply to your current billing period.
Subscriptions
Monthly subscriptions renew automatically on the same date each month. You may cancel at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing period — you retain access until that date.
One-time purchases
Starter plan purchases are one-time, non-recurring charges for a single review session.
Refunds
If you experience a technical failure that prevents you from completing a review and the issue is attributable to our Service, submit a request via our contact form and we will issue a refund for that review. We do not issue refunds for reviews that completed successfully but produced findings you disagree with — AI findings are subject to professional engineering review, as stated in these Terms.
7. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT AI-GENERATED FINDINGS WILL BE COMPLETE, ACCURATE, OR FREE FROM FALSE POSITIVES OR FALSE NEGATIVES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
8. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Service in breach of applicable law, or any claim that your uploaded content infringes a third party's rights.
9. Modifications to the service and terms
We reserve the right to modify or discontinue the Service at any time with reasonable notice. We may update these Terms from time to time. When we do, we will update the effective date and notify active subscribers by email. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
10. Termination
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or use the Service in a way that could harm us or other users. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately and any stored account data will be deleted within 90 days.
11. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Florida, and you consent to personal jurisdiction in those courts.
